Commercial terms & disclaimer

Our commercial roles

Depending on the cargo, jurisdiction and commercial circumstances, Pommer & Partners International Trading Limited may purchase cargo as principal for its own account, or act as salvage sale manager, remarketing partner, cargo recovery coordinator, recycling coordinator or disposal coordinator.

Where we purchase cargo, or may purchase it, we act in our own commercial interest as a party to the transaction and not as an independent adviser, valuer or surveyor. Any figure we give is our own market-based commercial assessment against available market information. It is not an independent valuation. Where an independent assessment is required, an independent third-party surveyor, laboratory or valuer must be appointed; we can coordinate that appointment, and the independence of such a third party is separate from our own commercial role.

Any purchase, sale, salvage, remarketing, recovery, recycling or disposal transaction is subject to individual assessment, contract, verification of title, applicable regulations, sanctions and compliance checks, logistics feasibility and local law.

Sanctions & trade compliance

All transactions are subject to applicable sanctions, export controls, trade restrictions, customs requirements and counterparty compliance checks. Pommer & Partners reserves the right to decline any transaction where legal, regulatory, sanctions, environmental or compliance requirements cannot be satisfactorily met.

Cargo title & authority to sell

Any party submitting cargo for purchase, remarketing, recovery or disposal must have the legal authority to do so, or be acting with appropriate authorisation from the relevant cargo interests. Documentation evidencing title, insurance position or authority may be required before a transaction can proceed.

This applies in particular to abandoned cargo, insurance salvage, insolvency stock, General Average situations, rejected cargo, cargo subject to liens, customs-controlled goods and cargo remaining aboard a vessel.

Food, feed & agricultural cargo

Potential alternative use of food or agricultural cargo, including animal-feed applications, depends on cargo condition, laboratory results, applicable food and feed regulations and approval by the relevant authorities where required. Suitability is never assumed and is not determined on commercial considerations alone.

Recovery, recycling & disposal

Recovery, recycling, destruction and disposal solutions are subject to applicable environmental, waste, transport and cross-border regulations, waste classification and customs requirements, and to the availability of appropriately authorised facilities. Cargo cannot simply be moved across borders for disposal.

Success-related arrangements

Success-related or "No Cure – No Pay" arrangements may be available for selected assignments and are subject to individual agreement. They do not apply automatically or universally, and nothing on this website constitutes an unconditional contractual promise.

What we collect

  • Contact details and cargo information contained in an email you send us. This website has no contact form: enquiries reach us only by email or telephone, and we receive only what you choose to send.
  • Technical data processed by our hosting and content-delivery provider when a page is requested (IP address, browser and device type, requested URL, timestamps), used for delivery, security and error diagnosis.

Why we use it

  • To respond to your inquiry and manage the resulting commercial file.
  • To meet our legal, accounting and regulatory obligations.
  • To protect the security and integrity of the website.

  • Technical error diagnosis — where a page fails to render, technical error information may be transmitted to our hosting platform's error-reporting facility.
  • Email — the email and telephone providers through which your enquiry reaches us.
  • Professional advisers and counterparties expressly involved in a cargo matter, and public authorities where required by law.

This website does not use analytics, advertising, profiling, tracking pixels, embedded maps, embedded social media, captcha or CRM integrations.

International transfers

Where personal data is transferred outside the EEA, we rely on appropriate safeguards under Chapter V GDPR, including adequacy decisions and Standard Contractual Clauses where applicable. This can occur with the hosting, content-delivery and web-font services referred to above, which may process data outside the EEA.

Retention

We retain personal data only for as long as required to fulfil the purpose for which it was collected and to comply with legal, tax and regulatory obligations. Fixed retention periods for enquiry correspondence have not been set out here; retention is determined by those criteria and can be confirmed on request.

Your rights

Cookies

In line with the European Communities (Electronic Communications Networks and Services) (Privacy and Electronic Communications) Regulations 2011 (S.I. 336/2011), this site does not use cookies or similar technologies for analytics, marketing or profiling.

Only strictly necessary technical storage required for the site to function correctly may be used. No consent banner is displayed because no non-essential cookies are set. Governing law & dispute resolution

Pommer & Partners International Trading Limited trades on a business-to-business basis and does not contract with consumers through this website. Consumer alternative dispute resolution mechanisms therefore do not apply. The European Commission's Online Dispute Resolution (ODR) platform for consumer disputes has been discontinued and is no longer referenced here.

The governing law and forum for any individual transaction are those agreed in the relevant contract. Where nothing is agreed, the law of Ireland applies to the use of this website.
