Definition
A cargo salvage sale is the commercial realisation of residual cargo value where the original commercial use of the cargo has been affected.
Salvage sales typically follow damage, contamination, rejection, deterioration, temperature deviation, abandonment, marine casualty, destination-market rejection or other circumstances affecting the intended commercial use of the cargo. The cargo is assessed and traded in its actual condition, on the basis of the documentation, survey findings and analytical results available at the time.
A salvage sale is therefore a claims and recovery instrument, not a discount sale. It establishes what the cargo is still commercially worth in a lawful alternative market or application, and how quickly that value can be converted while exposure continues to accrue in a vessel, port, terminal or warehouse.

Parties involved
Depending on title, insurance arrangements, contractual rights and the circumstances of the loss, a salvage sale may be instructed or coordinated by the relevant cargo interests, insurers, shipowners, claims professionals or authorised representatives. Not every party connected with a cargo has authority to sell it, and the position is clarified case by case before a transaction proceeds.
We are accustomed to working alongside claims files that already involve survey instructions, laboratory analysis, terminal deadlines and, in casualty cases, general average or recovery specialists acting for several interests at once.

Two routes
Both routes are available. Which is appropriate depends on the cargo, the market and the time available.
Principal
Pommer & Partners may purchase suitable distressed or salvage cargo directly as principal buyer, using its own capital. Purchase is always subject to commercial evaluation and cannot be guaranteed in advance.
Coordinator
Where direct acquisition is not the optimal route, we may support a structured sale or remarketing process involving external buyers. No particular price level or maximum recovery can be promised.

Salvage sale questions
A salvage sale starts with documentation, survey and laboratory evidence and confirmation of who may sell. The cargo is then offered to suitable buyers or purchased directly by Pommer & Partners, terms are agreed — price, payment, removal, container return and risk allocation — and the transaction is completed with release and documentary close-out.
Authority usually rests with the cargo owner. An insurer’s entitlement to deal with remaining cargo depends on the applicable law, policy terms, claims settlement and any relevant abandonment, transfer or other proprietary rights. A P&I Club’s approval of a sale does not by itself establish title. Authority to sell must be established before the transaction.
The highest nominal bid is not always the best outcome. A buyer should be judged on the net recovery it delivers and on whether it actually completes. A lower offer from a buyer who pays reliably, removes promptly and takes on clearly defined obligations can leave the seller better off than a higher bid that collapses or drags on.
A completed salvage sale may reduce the overall financial loss through net sale proceeds and genuinely avoided future costs. Who is entitled to the proceeds or benefits, and how they affect an insurance or P&I settlement, depends on title to the salvage, policy terms, indemnity or settlement rights, agreed allocation and governing law; proceeds are not automatically credited to a claim or payable to an insurer or P&I Club. Compare realistic routes on the same net economic basis: distinguish costs already incurred from future costs that are actually avoidable, deduct the costs of achieving each route and do not count the same saving twice. An uncompleted offer or contingent recovery is not realised proceeds; any financial benefit remains subject to completion and the relevant rights and liabilities.
