Who Is Responsible for Demurrage, Detention and Container Release?
Responsibility depends on the contract of carriage, applicable carrier tariff, terminal terms and governing law, including the obligations of the parties defined as merchant. A cargo sale may help reduce future exposure, but title transfer does not itself stop charges or release the original debtor. Buyer and seller can allocate devanning, removal, empty return and costs between themselves; that allocation alone does not bind carriers, terminals or public authorities, or transfer statutory liabilities. Container release and return, and any discharge of demurrage or detention obligations, need separate binding arrangements where relevant, including any required consent.
